A federal appeals court has temporarily reinstated the policy that prohibits openly gay men and women from serving in the military — but prohibited any investigation, penalties or discharges under the rule. A three-judge panel on the Court of Appeals for the Ninth Circuit had, on July 6, ordered the military to end the policy. The judges issued the three-page order late Friday in response to an emergency request by the Obama administration to let the Department of Defense continue its repeal process in an orderly fashion. The government provided “considerably more detailed information” about the repeal in its most recent filings, including statements that the military would be presenting its certification to repeal the policy to the president and top military officials “in a matter of weeks.” “Don’t ask, don’t tell” will officially end 60 days after certification.
